Public offer agreement
on the provision of temporary accommodation services**
Effective Date: 01.06.2025
1. General Provisions
This document is an official offer (public offer) by individual entrepreneur Denysenko L.I., acting under the laws of Ukraine (hereinafter referred to as the “Service Provider” or the “Hotel”), to conclude a contract under the terms outlined herein with any legally capable individual who accepts this offer (hereinafter referred to as the “Customer” or the “Guest”).
Services – temporary accommodation services provided by hotels or similar lodging facilities.
Agreement – this User Agreement.
Accommodation Facility – the lodging provided to the Guest.
Booking – reservation of the Accommodation Facility by the Guest for a specific period.
The offer is considered accepted when the Customer performs an action indicating consent — for example, submitting a request through the website https://mirax-hotel.com.ua, booking via phone, email, or any other method.
2. Subject of the Agreement

The Service Provider agrees to provide the Customer with temporary accommodation services at the Mirax Boutique Hotel, located at: 86A Heroiv Kharkova Ave., Kharkiv, in accordance with the chosen accommodation conditions. The Customer agrees to pay for these services.

By making a Booking, the Customer confirms they are aware of and fully agree with the terms of this Agreement and the Privacy Policy, accepts the offer to conclude the Agreement, and consents to the processing of their personal data.

Upon concluding the Agreement, the Guest confirms having the legal capacity to enter into and fulfill the Agreement, without being limited by law, court decision, or other regulations.
3. Booking Procedure

Booking is made via the website, email, phone, or messengers listed on the hotel’s website.

The Customer must provide accurate contact information.

A booking is considered confirmed after receiving confirmation from the Service Provider.

Check-in: from 14:00;
Check-out: until 12:00. -
The Service Provider guarantees not to use the information provided by the Guest during Booking for any purposes other than those specified in this Agreement.
4. Service Cost and Payment Procedure

Current accommodation prices are published on the hotel’s website.

Payment can be made in cashless form (via payment services) or in cash on site.

The Customer confirms they have reviewed the price and conditions during booking.

Service cost may vary depending on the Accommodation Facility selected by the Guest.

Prices are set in Ukrainian national currency – UAH (hryvnia).
-
The Service Provider may change prices unilaterally before payment is made by the Guest.
-
The Service Provider does not access, collect, store, or process Guest’s bank card or other payment information.
-
For payment-related issues, the Guest must contact the Payment System directly.

The Service Provider reserves the right to deny services to Guests who have not completed payment.
5. Booking Cancellation and Modification. Refunds

Booking can be canceled or modified according to the terms provided during the booking process.

In case of late cancellation or no-show, a penalty of the first night’s cost or according to promotional rate rules may apply.

The Service Provider may refuse service or cancel a Guest’s booking in the following cases:

Violation of this Agreement by the Guest;

Provision of false information during Booking;
-
Guest’s actions lead to or may lead to violation of the rights of the Service Provider or third parties;

Guest’s actions lead to or may lead to violation of Ukrainian law;
-
Guest’s actions may result in third-party claims against the Service Provider.

The Guest may request a refund under the conditions specified in the Agreement.

To request a refund, the Guest must provide the following:
-
Full name;
-
Taxpayer identification number;
-
Registered address;
-
IBAN and bank card number used for payment;
-
Scanned copy of payment receipt.

Upon receiving a refund request and the necessary documents, the Service Provider will issue a refund within 30 calendar days.
- Refunds to the client when paying by card are made to the same details from which the payment was made.

Failure to meet the deadlines or conditions may result in denial of the refund request.
6. Rights and Obligations of the Parties
The Service Provider agrees to:

Provide proper accommodation conditions according to the selected room and rate.

Ensure the confidentiality of the Customer’s personal data.
The Customer agrees to:

Follow the hotel’s accommodation rules.
-
Pay for the services in a timely manner.
AS IS:
-
Services are provided “as is”, according to the operational, technical, and other capabilities of the Service Provider. The Guest accepts the Services with all present or potential deficiencies.

The Guest has no right to make claims due to unmet expectations or third-party service performance (e.g., website, payment system disruptions).
7. Liability
The Service Provider is not liable for:

Inability to provide Services due to external factors beyond their control;
-
Actions of third parties;
-
Damages not caused by the Service Provider.
The Service Provider is liable for:

Violations in service provision.
The Guest is liable for:
-
Damage or destruction of the Service Provider’s property;
-
Misuse of accommodation in violation of this Agreement.

The Service Provider is not liable for technical issues with payment systems or the safety of the Guest’s payment data.
-
The Service Provider is not responsible for any material or moral damages due to force majeure.
-
The Guest is responsible for any accidental damage within the value of the item or its repair, payable before departure or within one banking day. In case of late payment, a 10% fine may apply every 10 calendar days.

The Service Provider’s total liability is limited to the cost of services paid by the Guest.
8. Personal Data Processing
By making a Booking, the Customer agrees to the processing of their personal data for service provision in accordance with the Privacy Policy.
9. Validity Period of the Offer
This offer is indefinite and remains in effect until revoked by the Service Provider. The Service Provider may amend the offer at any time by publishing a new version on the website.
