Public offer
for the provision of temporary accommodation services**
Effective Date: 01.06.2025
1. General Provisions
This document is the official public offer of the sole proprietor Denysenko A.I. (hereinafter — “Provider” or “Hotel”), operating under the legislation of Ukraine, and is addressed to any legally capable individual (hereinafter — “Client” or “Guest”) for the purpose of concluding a contract under the terms set forth below.
Services — accommodation services provided at the hotel or a similar establishment.
Contract — this service provision agreement.
Accommodation Unit — the room or apartment provided to the Guest.
Booking — the placement and confirmation of a request for accommodation for a specified period.
The offer is considered accepted by the Client upon performing actions indicating consent to its terms — for example, booking on the website https://mirax-hotel.com.ua/sapphire/, by phone, email, or other means.
2. Subject of the Contract
- The Provider undertakes to provide the Client with temporary accommodation services at Mirax Sapphire Boutique Hotel, located at 30 Danilevskogo St., Kharkiv, Ukraine, 61058, and the Client agrees to pay for such services in full.
- By making a booking, the Client confirms that they have read the terms of this offer, the Privacy Policy, and fully accept them, as well as consent to the processing of their personal data.
- The Client confirms that they are fully legally capable and have the right to enter into this contract.
3. Booking Procedure
- Booking is possible via the website, email, phone, or messengers listed on the Hotel’s website.
- The Client agrees to provide accurate contact information.
- The booking is considered confirmed after the Client receives a corresponding confirmation from the Provider.
- Check-in and check-out times:
- Check-in: from 14:00
- Check-out: until 12:00
- The Client’s personal data is processed solely for the purpose of fulfilling the contract and in accordance with the Privacy Policy.
4. Cost and Payment Procedure
- Current rates are listed on the official Hotel website.
- Payment can be made by cashless methods (including online payment) or in cash upon check-in.
- The Client confirms that they have reviewed the current rates and booking terms.
- The cost depends on the selected type of accommodation unit.
- All prices are indicated in Ukrainian Hryvnia (UAH).
- The Provider reserves the right to change prices until full payment is received.
- The Provider does not store or process payment data (e.g., bank card numbers).
- In case of payment issues, the Client should contact the payment service provider.
- Failure to pay may result in refusal of service by the Provider.
5. Cancellation, Changes, and Refunds
- Cancellation or changes to bookings are possible under the conditions specified at the time of booking.
- No-shows or late cancellations may be charged for the first night or another amount as per the specific promotion terms.
- The Provider reserves the right to cancel or reject bookings if:
- The Client violates the terms of this contract;
- False or inaccurate information is provided;
- The Client’s behavior poses a threat to the safety, health, or comfort of other guests or staff;
- Ukrainian law is violated;
- The Client’s actions may cause risks or claims from third parties.
- The Client has the right to refuse services and receive a refund subject to the terms of the specific tariff.
- To request a refund, the following must be provided:
- Full name of the Client;
- Taxpayer Identification Number (if available);
- Residential address;
- IBAN and card number from which payment was made;
- Payment confirmation (screenshot or receipt).
- Refunds are processed within 30 calendar days after receiving all required information.
- Refunds for card payments are made to the same payment details used for the original payment.
- Incomplete or untimely submission of information may result in no refund.
6. Rights and Obligations of the Parties
The Provider undertakes to:
- Provide services according to the booking terms;
- Ensure the confidentiality of the Client’s data.
The Client undertakes to:
- Comply with the Hotel’s internal rules;
- Pay for the services on time.
Services are provided “AS IS”:
- Services are provided in the condition they are at the time of booking.
- The Provider is not responsible for the Client’s unmet expectations, or technical failures caused by external factors (e.g., payment systems), unless otherwise stated in the contract.
7. Liability of the Parties
- The Provider is not liable for:
- Failure to fulfill obligations due to force majeure;
- Actions of third parties;
- Damages not directly caused by the Provider’s fault.
- The Provider’s liability is limited only to the obligations under the contract.
- The Client is liable for:
- Intentional or negligent damage to property;
- Misuse of services.
- The Provider is not responsible for:
- Operation of third-party payment services;
- Storage of the Client’s payment data.
- In case of force majeure, the parties are released from liability.
- If property is damaged, the Client must compensate damages before leaving the hotel or within 1 business day after the claim is made. For each subsequent 10-day period of delay, a penalty of 10% of the damage amount is charged.
- The maximum liability of the Provider shall not exceed the amount paid by the Client.
8. Personal Data Protection
By making a booking, the Client consents to the processing of personal data in accordance with the Privacy Policy, solely for the purpose of fulfilling the contract.
9. Term of the Offer
This offer is valid indefinitely until revoked or modified by the Provider. Any changes take effect from the moment a new version is published on the official website.
